Acceptance of These Terms

These Terms of Service govern the use of this website and the professional services provided by Awesome Szasz, LLC from its workshop at 1234 E Bryan Ave, Salt Lake City - 84105-2510, United States (US). By using the website, requesting an intake appointment or authorizing a work order, a client agrees to these terms. A person who does not agree should not submit equipment, data or a request for service.

Where a signed service agreement exists between a client and the company, that agreement governs in the event of a conflict with these terms. These terms fill the gaps and describe the standard bench practice that applies when no separate agreement addresses a point.

Definitions

In these terms, the company refers to Awesome Szasz, LLC. The client refers to the person or organization that requests service or that owns the equipment brought to the bench. Equipment means any hardware, storage device, cabinet, terminal or other item taken in for work. System means the combination of hardware, software, network and records that the client asks us to review, repair or design.

Intake tag means the record created when equipment or an account arrives. Work order means the written plan of tasks approved for a job. Bench test window means a scheduled period during which a finished system is exercised against agreed routines. Pickup slip means the numbered release record issued when a job is collected.

Services Provided

The company provides computer integrated systems design and related professional, scientific and technical services. Work may include assessment of an existing estate, design of an integrated configuration, installation and configuration of components, repair and replacement of failed parts, validation of backups, tuning of scheduling and record keeping tools, and recurring tune-up sittings.

Every job is placed at one of six bench stations described on the services page: intake tag bays, work order runs, pickup slip desks, bench test windows, parts order reviews and tune-up sittings. A job may pass through several stations. The station assigned to a job does not limit the technical work that may be performed, but it does determine the records that are created and the approvals that are sought.

We do not provide emergency medical, legal or financial advice. Where a design decision carries a regulatory consequence, we will explain the consequence as we understand it and recommend that the client obtain specialist advice.

Intake Tags

All equipment and accounts arrive through intake. The intake record describes the item, the condition observed, the date and the configuration history supplied by the client. Photographs are taken when a unit carries cosmetic marks. A copy of the tag is provided to the client, and the client is expected to review it and raise any discrepancy before work begins.

The client is responsible for backing up data that matters before bringing equipment to the bench, unless a backup service is included in the work order. Intake is not a data recovery service unless the work order says so. Where a unit arrives in a degraded state, the tag records that state and the client accepts that further deterioration may occur while work proceeds.

Accounts, credentials and licence identifiers supplied at intake are recorded only to the extent needed for the job. Credentials are not written on the pickup slip and are returned in sealed form or reset in the presence of the client.

Work Orders

A work order is prepared after intake and shared with the client before bench work begins. The order lists each task, the expected result, the bench window assigned and the person who will sign it off. The client approves the order in writing, by email or by signature at the desk. Work does not begin until approval is recorded.

If a technician discovers a fault that was not visible at intake, the order is amended in writing and the client is asked to approve the additional line. A client may decline the additional line, in which case the original scope is completed and the discovered fault is documented for later attention.

Estimates in a work order are made in good faith. Where an estimate is likely to be exceeded, the company will contact the client before continuing. Silence from a client does not count as approval for extra work.

Bench Test Windows

A finished system normally spends a scheduled window on the test bench. The routines run during the window are agreed in advance and may include boot order, service dependencies, scheduled jobs, backup restoration, scanning and label printing paths, or other checks specific to the design. The purpose of the window is to catch problems that do not appear in a short trial.

A system is released only after the window has completed cleanly or after the client has accepted a documented exception. If a window reveals a failure, the system returns to the bench, the work order is reopened and the window is repeated after the fix. Time spent repeating a window caused by our work is not billed a second time.

Parts Order Reviews

A parts order review examines each component that touches the system and asks whether it is supported, whether a compatible replacement exists and whether it is likely to fail before the next sitting. The review produces a short list with reasons, not a general catalog.

Parts are ordered only with client approval. Where a part is unavailable, the company will propose alternatives and explain any change in behavior. The client chooses whether to substitute, defer or cancel the line. Products supplied by third parties carry the warranty offered by their manufacturer.

Pickup Slips and Collection

Equipment is released through the pickup slip desk. The technician checks the finished system against the intake tag and the completed work order before a slip is issued. The slip records the items collected, the date, the person collecting and any replaced part that is being returned. The client signs for collection or authorizes a carrier to do so.

A person collecting on behalf of a client must be named in advance or present written authority. Where collection is arranged through a carrier, the slip is sent to the client by email at the moment of release so that the chain of custody remains clear.

Tune-Up Sittings

Tune-up sittings are recurring review visits that keep an integrated estate healthy. A sitting typically revisits backups, updates, cabling, time keeping, label printing and the workflow assumptions behind the original design. The scope of each sitting is agreed before it is booked and is recorded as a work order in the usual way.

Sittings may be booked one at a time or as a schedule. Where a schedule is agreed, either party may end it with reasonable notice. A sitting that is cancelled within a short period of the booked window may incur a charge to cover the reserved bench time, as described in the fees section.

Client Responsibilities

The client is responsible for providing accurate information about the system, for disclosing known faults and for supplying credentials needed for the work. The client is also responsible for maintaining backups of critical data, for ensuring that it has the right to authorize work on the equipment it brings in, and for complying with any licence terms that apply to software installed on the system.

A client must not bring equipment that is contaminated, unsafe or subject to a legal hold without telling us first. A client must not ask the bench to perform work that would breach a law or a third party right. Where such a request is made, the company may decline the work and return the equipment.

Fees and Payment

Fees are stated in the work order and reflect the benches time reserved for a job. Time and materials work is billed at the rate stated in the order. Fixed price work is billed at the fixed amount unless the scope changes with client approval. Parts are billed at the price quoted in the review, plus any applicable tax.

Invoices are payable on the terms shown on the invoice. Overdue amounts may be subject to a charge permitted by law. The company may withhold release of equipment while a related invoice remains unpaid, provided that the client has been notified and the amount is genuinely due.

A booking cancelled with little notice may be charged for the reserved window. The company will always explain the charge and will waive it where the cancellation was caused by illness, a transport failure or another reasonable circumstance.

Workmanship Warranty

The company warrants that work performed by its technicians will be carried out with reasonable skill and care and that a repaired component will function as described in the work order for a period stated on the slip. If a fault attributable to our work appears during that period, we will inspect the system and correct the fault at no additional charge for labor.

The warranty does not cover damage caused by accident, misuse, power events, environmental conditions, unauthorized changes made after release, or software installed contrary to its licence terms. It also does not cover the natural end of life of a component that the client declined to replace.

Except for the warranty stated in this section, the company provides services without further warranty, to the extent permitted by law. Nothing in this section limits a non waivable right provided by statute.

Limitation of Liability

To the extent permitted by law, the company will not be liable for indirect, incidental, special or consequential losses, including lost profits, lost business opportunities or loss of goodwill. The company will not be liable for any loss of data that could have been avoided by a backup the client was responsible for maintaining.

The total liability of the company for a claim connected with a job will not exceed the amount paid for the services giving rise to the claim. Where equipment is lost or damaged through our negligence, the remedy will be repair, replacement of equivalent condition or a payment reflecting the value of the item, at the company option.

Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence.

Indemnity

A client agrees to indemnify the company against claims, losses and reasonable costs arising from equipment or data the client was not entitled to provide, from instructions that breach a law or a third party right, or from a breach of the client responsibilities described in these terms.

The company agrees to indemnify the client against claims that our work infringes a third party intellectual property right, provided the client notifies us promptly and allows us to direct the response. This indemnity does not apply where the claim arises from client supplied material or from changes the client made after release.

Confidentiality

Each party will keep the other party confidential information private and will use it only for the job. For the company, this includes client system contents, account names, records and any business information a client shares. For the client, this includes bench records, work methods and any technical material we provide that is marked as confidential.

Confidentiality obligations do not apply to information that is already public, that a party independently develops without using the other party material, or that must be disclosed by law. Where disclosure is required, the party subject to the requirement will give notice where it can and will limit the disclosure to what is necessary.

Data and System Contents

Client data belongs to the client. The company accesses system contents only to the extent needed to perform the work order. Staff do not inspect business records, correspondence or personal files beyond what is technically necessary, and any incidental knowledge gained is treated as confidential.

The client should remove or secure information that is not needed for the job. Where a job requires a storage device to be replaced, the original device may be returned or destroyed in accordance with client instruction recorded on the pickup slip.

Where work involves personal information governed by privacy law, the client remains the controller and the company acts under the client instruction. The privacy policy on this site describes how the company handles information it collects in its own right.

Uncollected Equipment

Equipment that is ready for collection but remains at the workshop for an extended period places a real burden on the bench. The company will contact the client at the email and telephone number on file and send a written reminder. If equipment is not collected within a reasonable period after those reminders, the company may apply the remedy permitted by applicable law, which may include a storage charge or disposal of the item after proper notice.

Before any disposal, the company will make reasonable efforts to secure any client data on the equipment or to destroy it in a way that prevents recovery. Proceeds from a lawful sale of uncollected equipment will be applied to outstanding amounts and the balance handled as the law requires.

Suspension and Termination

Either party may end an ongoing relationship with reasonable notice. The company may suspend work immediately where a safety risk arises, where a client misrepresents the equipment, where a payment remains unpaid after proper notice, or where continuing would require a breach of law.

On termination, the client remains liable for work completed and parts ordered with approval. The company will return equipment in a condition consistent with the work completed and will issue a final pickup slip that records the state of the job.

Third Party Products

Integrated systems often rely on products made by other companies. The company does not manufacture those products and cannot guarantee their behavior. Manufacturer warranties, licence terms and support arrangements remain between the client and the manufacturer.

Where a manufacturer withdraws support for a product, the company will explain the consequence and propose a path forward. The company is not responsible for a delay caused by a manufacturer supply failure, though it will pursue alternatives where a reasonable one exists.

Intellectual Property

The text, layout and visual work on this website belong to Awesome Szasz, LLC. A visitor may view and print pages for personal or internal business use. Republishing substantial portions without written permission is not allowed.

Technical material prepared for a client, such as a configuration note or a bench record, is provided for the client internal use. The company retains ownership of its underlying methods, templates and tools. Where a deliverable is intended to be transferred, the work order will say so.

Dispute Resolution

If a concern arises about a job, please raise it with the workshop first. Most issues can be resolved by reviewing the intake tag, the work order and the test record together. The company will respond within a reasonable time and will propose a practical remedy where one is due.

If direct discussion does not resolve the matter, the parties agree to attempt mediation before starting formal proceedings, except where urgent relief is needed. Mediation costs are shared equally unless the mediator decides otherwise.

Governing Law

These terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Subject to the dispute resolution section, the state and federal courts located in Utah have exclusive jurisdiction over any proceeding connected with these terms.

If a provision of these terms is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

Changes to These Terms

The company may update these terms to reflect changes in practice or law. The current version is always available on this page. A material change will be brought to the attention of active clients by email where practical.

A job approved before a change continues under the terms in force at the time of approval, unless the client agrees otherwise in writing.
